Terms of Service

1. Acceptance of Terms

By accessing or using the App, you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility and Age Requirement

You must be at least 18 years old, or the age of legal majority in your location, to create an account and purchase a subscription. If you are under the age of legal majority, you may use the App only with permission and supervision from a parent or legal guardian, who agrees to be responsible for your use of the App.

3. Accounts and Subscriptions

To access most features of the App you must create an account and maintain an active subscription. You agree to provide accurate, current information when creating your account, to keep your credentials confidential, and to notify us promptly of any unauthorized use.

Subscriptions are sold through the Apple App Store, Google Play Store, or directly through the App, as applicable. The price, billing period, auto-renewal terms, free-trial terms, and cancellation timing are disclosed at the point of purchase and are subject to the policies of the applicable store. Prices may vary by country, region, platform, promotional offer, taxes, or app store requirements.

Subscription cancellation and refund requests must be handled through the store from which the subscription was purchased, subject to that store's policies.

4. Content and Educational Disclaimer

The App does not provide emergency, medical, legal, or professional healthcare services. Do not use the App to diagnose or treat medical conditions.

Essential oils can cause irritation, sensitization, allergic reactions, phototoxic reactions, or other adverse effects if used improperly. Always follow appropriate dilution, safety, and usage guidelines. Do not ingest essential oils unless advised by a qualified healthcare professional trained in that use.

Use extra caution with children, pregnancy, nursing, older adults, pets, allergies, asthma, epilepsy, medical conditions, medications, sensitive skin, damaged skin, and sun exposure.

You are solely responsible for how you use the information in the App and for any decisions you make based on it.

5. Thymely Aromatherapist Chat

The App includes Thymely Aromatherapist ("Thymely"), an AI-powered chat assistant. Thymely produces responses based on proprietary educational content licensed to or owned by ThriveEO LLC, combined with general language-model capabilities provided by third-party AI service providers.

Thymely responses are intended for general education only and may contain errors, omissions, or out-of-date information. Do not rely on Thymely for emergency, medical, legal, diagnostic, or other professional advice.

Do not submit emergency, highly sensitive, or urgent medical information through Thymely. If you believe you may have a medical emergency, contact emergency services or a qualified healthcare professional immediately.

Responses generated by Thymely are App content under Section 7 and are subject to the personal-use, permission, and citation requirements in Section 8.

6. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any manner that violates any applicable law or regulation.
• Attempt to gain unauthorized access to the App, other users' accounts, or our systems.
• Interfere with or disrupt the App, its servers, or networks connected to the App.
• Reverse engineer, decompile, or attempt to extract source code or model weights from the App, except to the extent expressly permitted by applicable law.
• Use any automated means, including bots, scrapers, crawlers, or AI agents, to access, copy, harvest, or index App content, except as expressly permitted in writing by us.
• Share, resell, sublicense, or transfer your account, login credentials, or subscription.
• Use the App to harass, threaten, defame, or harm others.
• Use App content for commercial classes, client handouts, paid downloads, books, websites, social media, courses, professional materials, artificial intelligence training, or other public or commercial use without our prior written permission. Where permission is granted, you must also provide proper citation as described in Section 8.

7. Intellectual Property and Proprietary Content

All recipes, essential oil profiles, safety notes, educational materials, images, text, charts, formulas, organization, design, answers, summaries, and other responses generated by the Thymely chat assistant, and other content in the App (collectively, "App content") are owned by or licensed to ThriveEO LLC and are protected by copyright, trademark, and other intellectual property laws of the United States and other countries.

The App contains proprietary educational content developed for and owned by ThriveEO LLC. Your subscription gives you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the App content for your own personal, non-commercial use only.

Responses generated by Thymely, including any text, recommendations, summaries, lists, or other output produced in response to user prompts, are App content owned by ThriveEO LLC. The fact that a Thymely response is produced in reply to a question, prompt, or input that you submit does not give you any ownership, authorship, co-authorship, or commercial-use rights in the response. Your right to use Thymely responses is limited to the personal, non-commercial license granted in this section, and is subject to the permission and citation requirements in Section 8.

The "Aromatherapy Recipes" and "Thymely" names, logos, app design, branding, and related marks are trademarks or service marks of ThriveEO LLC. You may not use them without our prior written permission.

You may not copy, reproduce, publish, distribute, sell, license, teach from, upload, scrape, train artificial intelligence systems on, or create derivative works from App content without our prior written permission.

Violation of this Section 7 is a material breach of these Terms. We may immediately suspend your account, cancel your subscription, and permanently ban you from the App and any related services, as described in Section 9, in addition to pursuing any other legal or equitable remedies available to us.

Nothing in these Terms transfers ownership of App content or intellectual property rights to you.

8. Personal Use, Permission, and Citation

App content is provided for your personal educational use only.

You may not use App content for commercial classes, client handouts, paid downloads, books, websites, social media content, courses, professional materials, artificial intelligence training, or other public or commercial uses without our prior written permission.

If we give written permission for use outside personal use, or if you reference limited portions of the content in a way permitted by law, you must provide clear attribution to the source.

Aromatherapy Recipes app and website

For recipes, essential oil profiles, and other content drawn from the Aromatherapy Recipes app or website, attribution should include the recipe or profile title, "Aromatherapy Recipes," and the URL https://aromatherapy-recipes.com.

Thymely Aromatherapist chat responses

For information drawn from a Thymely chat response, attribution must, at a minimum, identify "Thymely Aromatherapist" as the source and reference https://thriveeo.com. The exact wording can be adapted to your medium, but the source name and URL must both appear in a way a reader can easily see.

You may not strip, hide, or paraphrase away the attribution, and you may not present Thymely-derived content as your own original research, expertise, or opinion.

To request permission, contact us at the address in Section 15.

Failure to obtain prior written permission, or failure to provide required citation, is a material breach of these Terms. We may immediately suspend your account, cancel your subscription, and permanently ban you from the App and any related services, as described in Section 9.

Nothing in these Terms limits rights you may have under applicable law, such as fair use.

9. Termination, Cancellation, and Bans

If you violate these Terms — including the intellectual property, personal-use, permission, and citation requirements in Sections 6, 7, and 8 — we may, at our sole discretion and without prior notice:

• Suspend your account and access to the App;
• Cancel your subscription and revoke your license to use App content;
• Permanently ban you and any associated accounts, devices, and payment methods from the App and any related websites or services operated by ThriveEO LLC; and
• Refuse to provide the App or any related services to you in the future.

Grounds for cancellation and ban include, without limitation: copying, republishing, reselling, or scraping App content; using App content for commercial classes, client handouts, paid downloads, books, websites, social media, courses, or other public or commercial purposes without our prior written permission; using App content or Thymely responses to train artificial intelligence systems; failing to provide required citation; circumventing technical or access controls; sharing account credentials; interfering with the App's operation; or using the App in a way that may harm ThriveEO LLC, other users, or third-party service providers.

If your account is canceled or banned for violating these Terms, you will lose access to your account, saved content, notes, favorites, and collections, and you are not entitled to a refund of any subscription fees. Subscription cancellation and refund requests must still be handled through the Apple App Store or Google Play Store, as applicable, subject to their policies.

Cancellation and ban under this section do not waive any other rights or remedies available to ThriveEO LLC, including the right to seek injunctive relief, damages, attorneys' fees, and costs for violation of these Terms or applicable intellectual property law.

Termination does not waive the intellectual property, permission, or citation obligations in Sections 7 and 8, which survive any termination of your account or these Terms.

10. Disclaimers

THE APP AND ALL APP CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

We do not warrant that the App will be uninterrupted, error-free, secure, or that any defects will be corrected. We do not warrant the accuracy, completeness, or reliability of any App content, including any Thymely response.

Some jurisdictions do not allow the disclaimer of certain warranties, so portions of this section may not apply to you.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THRIVEEO LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP OR THESE TERMS, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE APP IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the limitation or exclusion of certain damages, so portions of this section may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless ThriveEO LLC and its officers, directors, employees, contractors, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the App, your violation of these Terms, your violation of any third-party right, or your use of App content in violation of Sections 6, 7, or 8.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Montana, United States, without regard to conflict of law principles. You agree that any dispute arising out of or relating to these Terms or your use of the App will be brought exclusively in the state or federal courts located in Montana, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you in the App or by email. Your continued use of the App after the updated Terms take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.

16. Miscellaneous

These Terms, together with our Privacy Policy and any additional terms presented at the point of purchase, constitute the entire agreement between you and ThriveEO LLC concerning the App. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
